N13: Notice to End your Tenancy Because the Landlord Wants to Demolish the Rental Unit, Repair it or Convert it to Another Use

 

      • Reason 1: Demolition. 
      • Reason 2: Extensive repairs or renovations. 
      • Reason 3: Conversion to non-residential use. 

N13: Notice to End your Tenancy Because the Landlord Wants to Demolish the Rental Unit, Repair it or Convert it to Another Use  

STEP 1:  

  • Identify the rental period. 
  • Notice period is 120 days. 
  • Compensation: Pay tenant one month’s rent on or before the termination date in the notice. 
  • Offer: Provide the unit back to the tenant at the same rental rate or offer a similar unit. 
  • Renovation Scope: Renovations must be significant enough to render the property uninhabitable during the process. 
  • Permits: Obtain necessary permits for renovations, as documentation may be required. 

STEP 2: Serving the Notice of Termination 

  • Confirm if the tenant consents to email. 
  • If yes, email the documents followed by Canada Post next day delivery. 
  • If not, send only by Canada Post next day delivery. 
  • We recommend sending it both ways to ensure delivery. 

STEP 3: Pricing Explanation 

  • Our firm strongly believes in fixed fee rates for transparency and predictability. 
  • Clarify the fixed fee rates for the service. 
  • Prices do not include taxes and disbursements. 

STEP 4: Application Serving 

  • This step is billed separately as we do not want to charge you if this step is not needed.  
  • To serve the application: 
  • Serve L2/30 days to file after the term date – $186 File fee +Taxes  

STEP 5: Waiting for Hearing Date 

  • Await a hearing date from the Landlord and Tenant Board.
