Step 1: Eligibility
- Use this form to apply to the Landlord and Tenant Board (LTB) if you believe the landlord gave you a Notice of Termination in bad faith.
- Eligibility:
- Former tenant who moved out due to receiving:
- Form N12: Notice to End your Tenancy Because the Landlord, a Purchaser or a Family Member Requires the Rental Unit.
- Form N13: Notice to End your Tenancy Because the Landlord Wants to Demolish the Rental Unit, repair it, or Convert it to Another Use.
Step 2: Counter Argument
- Review the Allegations: Examine the T5 Notice to understand the tenant’s specific claims about the Notice of Termination being given in bad faith.
- Gather Evidence: Collect evidence supporting your actions, such as communication with the tenant, tenancy agreement documentation, tenant breaches, maintenance records, etc.
- Prepare a Response: Draft a comprehensive response addressing each allegation with supporting evidence.
Attend the Hearing: If a hearing is scheduled, attend with all evidence and be ready to present your case effectively.
- Remember, the burden of proof is on the tenant to demonstrate bad faith. Your goal is to refute their claims with evidence demonstrating lawful termination.
