Hello Landlords,

One of our trusted landlords recently asked a question in our Facebook Group https://www.facebook.com/share/g/1MyuUtrT4s/.

QUESTION:

“Looking to seek clarity on 2 questions regarding joint tenancy.

My friend has 2 people in his rental as joint tenant.

1. One of them want to leave (it’s month to month) . Would other one be solely responsible for rent?

2. What’s the minimum notice they have to give to landlord considering it’s past original fixed term (month to month)”

ANSWER:

If One Joint Tenant Leaves:
In a joint tenancy, both tenants are jointly and severally responsible for the rent. If one tenant leaves, the remaining tenant is still responsible for the full rent. The landlord does not have to accept a partial rent payment from the remaining tenant unless a new agreement is made.

Minimum Notice for Month-to-Month Tenancy:
Since the lease is now month-to-month, either tenant must provide at least 60 days’ written notice to end the tenancy. This notice must be given on or before the rent due date, and the notice must end on the last day of a rental period.
