QUESTION:
“I have a tenant that has rented from me for a couple years he is on month to month now as his lease ran out. He has informed me he wants to move out by the end of the year. I have no problem with this I just wanted to make sure I am doing this right. What form do I need to get him to sign confirming he is moving out? “
ANSWER:
As a landlord, if your tenant intends to move out, you have two options to proceed:
- Form N9 (Tenant’s Notice to End the Tenancy): If the tenant is providing at least 60 days’ notice, you should have them complete Form N9. This form must be signed by the tenant and provide notice of at least 60 days before the intended move-out date.
- Form N11 (Agreement to End the Tenancy): If you and the tenant mutually agree on the move-out date, you can use Form N11. This form is a written agreement between both parties to end the tenancy on a specific date.
Once you have the completed Form N9 or N11, you may acknowledge the tenant’s notice in writing, confirming the move-out date. This written confirmation is good practice but not legally required. Ensure that all documentation is retained for your records.
