One of our trusted landlords recently asked a question in our Facebook Group ONTARIO LANDLORD HELP Q & A

QUESTION:

“Hi, I’m a new member to this group. I am looking to serve my tenant an eviction notice of 14 days. In March we signed a 1 yr lease. However in June she requested that i use her last month deposit for rent. So does that mean she is no longer a year tenant and has changed to monthly?

Also, when serving notice of nonpayment for rent, can I put the letter in an envelope and tape it to their front door? She’s rejecting my calls and no response via text and messenger. Don’t have an email address. Mail gets returned because Canada Post can’t find the house. What do I do?

ANSWER:

Does Using the Last Month’s Rent Deposit Change the Lease?
No, using the last month’s rent deposit for rent doesn’t change the lease type. If the 1-year lease has ended and not renewed, the tenancy automatically becomes month-to-month.

Serving a 14-Day Notice for Non-Payment of Rent (Form N4):
Yes, you can tape the notice to the tenant’s door if they’re unresponsive. Ensure you document the time and date. Other methods include personal delivery or mail (if the address is valid).

What to Do if the Tenant Avoids Communication:
If the tenant is unresponsive and you’ve served the notice correctly, you can apply to the Landlord and Tenant Board for eviction.
