N13 FORM- NOTICE TO END YOUR TENANCY BECAUSE THE LANDLORD WANTS TO DEMOLISH THE RENTAL UNIT, REPAIR IT OR CONVERT IT TO ANOTHER USE

  1. Section 1: When to use N13 form 
  • Reason 1: Landlord intends to demolish the unit or complex. 
  • Reason 2: Extensive repairs or renovations are needed, requiring the unit to be vacant. 
  • Reason 3: Landlord plans to convert the unit or complex to non-residential use. 

Note: If you are giving the tenant this notice for this reason, the tenant can choose to move back into the rental unit after the repairs or renovations are complete. However, before the tenant moves out, the tenant must inform you in writing of their intent to re-occupy the rental unit. The tenant must keep you informed in writing of any change in their address. 

  1. Section 2: Compensation Information  
  • Compensation required for converting or demolishing based on the number of residential units. 
  • Less than 5 residential units, compensation is equal to one month’s rent, 
  • More than 5 residential units, compensation is equal to three month’s rent, 
  • Or you can offer the tenant another rental unit that is acceptable to the tenant. 
  • For repairs or renovations, compensation varies based on tenant’s intent to return. If the tenant is returning: 
  • For rental units that are less than 5 residential units, compensation is equal to one month’s rent, or an amount equal to the rent for the period of time the rental unit will be under repair or renovation, whichever is less, 
  • For rental units that are more than 5 residential units, compensation is equal to three month’s rent, or an amount equal to the rent for the period of time the rental unit will be under repair or renovation, whichever is less, 
  • Or you can offer the tenant another rental unit that is acceptable to the tenant. 
  • Different compensation rules apply if the unit contains a tenant-owned mobile home. 
  1. Section 3: How to fill an N13 form 
  • Fill tenant’s name(s) under “To” and landlord’s name(s) under “From.” 
  • Provide the complete rental unit address. 
  • Termination Date: Minimum 120 days after notice, aligning with the last day of the rental period or fixed term. 
  • Example provided for calculating termination date. 
  1. Section 4: Reason for Ending Tenancy  
  • Shade the circle next to the reason. 
  • Describe work details and necessary permits. 
  1. Section 5: Signature  
  • Landlord or representative marks circle (Landlord/Representative), signs, and dates. 
  • Representative’s information if applicable. 
  1. Section 6: How to serve the N13 Notice to the Tenant  
  • Various delivery methods listed, excluding posting on the door. 
  1. Section 7: What is the next step after serving N13 form 
  • Keep a copy. 
  • Apply to the Landlord Tenant Board (LTB) within 30 days  after the termination date. 
  • Required forms: Application to End a Tenancy and Evict a Tenant (Form L2), Notice to End Tenancy (Form N13), and Certificate of Service.

  • Customer Service is available weekdays, with automated information available 24/7.
