N8: Notice to End your Tenancy at the End of the Term

For most types of tenancies (including monthly tenancies) the termination date must be at least 60 days after the landlord gives you this notice. Also, the termination date must be the last day of a rental period. For example, if you pay rent on the first of each month, the termination date must be the last day of the month. If the tenancy is for a fixed term (for example, a lease for one year), the termination date cannot be earlier than the last date of the fixed term. 

        • Reason 1: Persistent late rent payment. 
        • Reason 2: Ineligibility for public housing. 
        • Reason 3: Employment termination (conditional tenancy). 
        • Reason 4: Cancellation of condominium sale agreement. 
        • Reason 5: End of tenancy for care purposes. 

N8: Notice to End your Tenancy at the End of the Term (persistently late) 

Step 1: Assessing the N8 Notice 

  • Determine the rental period. 
  • Determine how often the tenant pays rent late. Make sure it’s documented, and you have clear proof. 
  • For a weekly or daily tenancy, the termination date must be at least 28 days after issuing the notice, on the last day of the rental period. 
  • For other tenancy types, such as monthly, the termination date must be at least 60 days after issuing the notice and must align with the last day of the rental period or, for fixed-term tenancies, the last day of the fixed term. 

Step 2: Serving the Notice 

  • Confirm if the tenant consents to email. 
  • If yes, email the documents followed by Canada Post next day delivery. 
  • If not, send only by Canada Post next day delivery. 
  • We recommend sending it both ways to ensure delivery. 
  • Complete the Certificate of Service to document when and how the notice was given. 
  • The termination period and the earliest filing with the board for eviction are not dependent on each other. You can apply to the Landlord and Tenant Board (LTB) for an order to terminate the tenancy immediately after giving the notice to the tenant. 
  • Ensure application is made no later than 30 days after the termination date specified in the notice.

Step 5: Waiting for Hearing Date 

  • Await a hearing date from the Landlord and Tenant Board.
