Step 1: Defense
- Document the opposite of what the tenant (TT) is alleging in this form.
- The tenant may file this if they feel the landlord (LL):
- Entered the rental unit illegally.
- Changed the locking system without providing replacement keys.
- Seriously interfered with the reasonable enjoyment of the rental unit or complex by the tenant or a member of their household.
- Withheld or interfered with vital services, care services, or meals.
- Harassed, interfered with, obstructed, coerced, or threatened the tenant.
- Didn’t give 72 hours to retrieve property after eviction by the Sheriff or disposed of property during this period.
- Didn’t provide a written copy of the tenancy agreement for a care home, or if it didn’t include information about care services, meals, and charges agreed upon.
Justify allegations with examples:
- Example: Tenant failed to pay water bill, causing water shut off.
- Landlord entered unit under emergency premise due to reported domestic situation by neighbor.
- This helps explain why the remedies the tenant seeks may be unjust.
